Cyber Terrorism & International Law at Oxford University

After the term ‘cyber terrorism’ was coined in 1996 by Barry Collin, who defined the term as the “convergence of cybernetics and terrorism”, FBI, defined it as any "premeditated, politically motivated attack against information, computer systems, computer programs, and data which results in violence against non-combatant targets by sub-national groups or clandestine agents. "Unlike a Trojan or computer attack that results in a denial of service, a cyberterrorist attack is designed to cause physical violence or extreme financial harm. There could be times where cyber terrorist would launch coordinated attacks in changing the orbits of the satellites and thus causing intra-space panic. It could destabilise defence communication systems. Cyber Terrorism has cyber space as battle space and is in tension with the international law governing the use of force. We need to move away from military analogy for upholding free to all nature of Internet. International law raises substantial barriers to both using cyber weapons and defending cyber space from cyber-attacks through the use of force. In the economic sphere, responses to violations tend to be known as ‘countermeasures’; in the arms control sphere, they are known as ‘sanctions’. Both are the coercive enforcement measures, not involving the use of significant military force, available to States acting in response to an internationally wrongful act.Further to the adoption by the Council of Europe of the Cybercrime Convention (2001) and the Convention on the Prevention of Terrorism (2005), the Committee of Experts on Terrorism (CODEXTER) has been surveying the situation in ...
