Digital Contracting Is Broken. A Little "Friction" Could Go a Long Way in Fixing It
In mid-October, the Federal Trade Commission (FTC) announced a final “click-to-cancel” rule, which, after its provisions go into effect, will make it easier for consumers to cancel recurring memberships and subscriptions. The rule is an undoubtable victory for consumers who have run into roadblocks attempting to protect their wallets amid the flurry of oversubscription in today’s world, but it also begets an important question: Why is oversubscription occurring in the first place? “One important reason for that problem is that getting into contracts is frictionless, it’s too easy,” said Brett Frischmann, JD, the Charles Widger Endowed Professor in Law, Business and Economics in Villanova University’s Charles Widger School of Law. “The FTC is addressing a real concern in making it easier for people to exit agreements of this sort. But while making it as easy to unsubscribe as to subscribe sounds great – we all like even playing fields and symmetry – it might be better to also make subscribing a little more burdensome, so people understand what they are getting themselves into in the first place.” This idea is the focus of Frischmann’s recent paper, titled "Better Digital Contracts with Prosocial Friction-in-Design," the publication of which coincides with public dissatisfaction over digital contracting processes. In August, Disney attempted to have a wrongful death lawsuit blocked, citing print in terms and conditions from a one-month Disney+ free trial the plaintiff signed up for in 2019. Since then, other companies have succeeded in recently blocking the commencement of similar lawsuits. In the research, Frischmann and his co-author, Rice University computer scientist Moshe Vardi, describe these contracts as “dehumanizing” and that they “undermine human autonomy and sociality, by design,” citing how they elicit behavior in a pre-determined manner (such as clicking on cue) and often include side agreements with other entities, unbeknownst to the users. “One-click” contracts rely on legal fictions, such as presuming that clicking an “I have read the terms and conditions” button actually means that they have. They are structured this way intentionally. “The idea behind digital contracting is ‘Let’s make the contract as quick as possible before people leave or change their mind,” Frischmann said. “They only want to do the minimum that the law requires, and all the law requires is notice of terms and action that says, ‘I agree.’” For these reasons, he argues, modern digital contracting contradicts the purpose of contract law in the first place; enabling people to reach genuine agreements and cooperate. “It’s antithetical to the underlying values of a contract,” Frischmann said. “Autonomy is undermined because people are not able to exercise autonomy in a meaningful way when they are not actually capable of deliberating about the terms to which they are agreeing. As for being cooperative, there is no relationship. Digital contracts are completely one-sided.” So what can be done to combat this? “Speedbumps,” Frischmann says, referring to measures that can cause friction in the contracting process to better protect the user. Physical road speedbumps represent a useful analogy, because while they make things slightly more inconvenient for the user, they are deployed strategically where other values are at stake, like the safety of children playing outside. “People tolerate speedbumps,” Frischmann says, “because they serve a social purpose. Friction in digital contracts is similar.” With respect to improving digital contracting, there are multiple measures that can be taken that inherently have such friction, but not all of them are always appropriate. Completely Automated Public Turing Test to Tell Computers and Humans Apart (CAPTCHAs), for example, are a type of friction-in-design that serve a useful social purpose (security) and have become normalized and tolerated, but some CAPTCHAs are ableist and others may generate proprietary data. Where he sees the most beneficial friction existing is in comprehension, which in software form could be completing a task or passing a test to prove an individual understands the agreement. Comprehension is the basis for one of Frischmann’s proposed alterations to contract law. Currently, the oft-criticized concept of informed consent is utilized. He argues it should be replaced with demonstrably informed consent, in essence requiring entities to further show that people truly comprehend what they are agreeing to. “Right now, individuals assent to contracts, going along with terms someone else insisted upon,” he said. “But assenting to terms is very different than being informed and consenting. To demand demonstrably informed consent shifts the burden on the provider to generate evidence showing in fact a person understood and agreed.” In the recent Disney case, for example, demonstrably informed consent would have required not just clicking an agreement when signing up for Disney+, but that Disney somehow explained to an individual that if they sign up for a free trial, they cannot take the company to court, and further generating reliable evidence that the individual understood that. If that were the case, perhaps the individual would not have signed up. “Or, they may not have ever gone to the Disney park if they had [signed up],” Frischmann said. This proposed change in contract law, along with the various potential methods of engineered friction in digital contracts all circle back to the same goal: slowing down contracting where it affects people in ways they do not understand. “You can’t have digital contracting built like a highway, where it’s all as fast as possible all the time,” Frischmann said. “For our digitally networked environment, it needs to be built like a neighborhood.”

New light technique could revolutionise non-invasive medical diagnostics Orbital Angular Momentum could be harnessed to improve imaging and data transmission through biological tissues Could eventually have potential to make procedures such as surgery or biopsies unnecessary. An Aston University researcher has developed a new technique using light which could revolutionise non-invasive medical diagnostics and optical communication. The research showcases how a type of light called the Orbital Angular Momentum (OAM) can be harnessed to improve imaging and data transmission through skin and other biological tissues. A team led by Professor Igor Meglinski found that OAM light has unmatched sensitivity and accuracy that could result in making procedures such as surgery or biopsies unnecessary. In addition it could enable doctors to track the progression of diseases and plan appropriate treatment options. OAM is defined as a type of structured light beams, which are light fields which have a tailored spatial structure. Often referred to as vortex beams, they have previously been applied to a number of developments in different applications including astronomy, microscopy, imaging, metrology, sensing, and optical communications. Professor Meglinski in collaboration with researchers from the University of Oulu, Finland conducted the research which is detailed in the paper “Phase preservation of orbital angular momentum of light in multiple scattering environment” which is published in the Nature journal Light Science & Application. The paper has since been named as one of the year’s most exciting pieces of research by international optics and photonics membership organisation, Optica. The study reveals that OAM retains its phase characteristics even when passing through highly scattering media, unlike regular light signals. This means it can detect extremely small changes with an accuracy of up to 0.000001 on the refractive index, far surpassing the capabilities of many current diagnostic technologies. Professor Meglinski who is based at Aston Institute of Photonic Technologies said: “By showing that OAM light can travel through turbid or cloudy and scattering media, the study opens up new possibilities for advanced biomedical applications. “For example, this technology could lead to more accurate and non-invasive ways to monitor blood glucose levels, providing an easier and less painful method for people with diabetes.” The research team conducted a series of controlled experiments, transmitting OAM beams through media with varying levels of turbidity and refractive indices. They used advanced detection techniques, including interferometry and digital holography, to capture and analyse the light's behaviour. They found that the consistency between experimental results and theoretical models highlighted the ability of the OAM-based approach. The researchers believe that their study’s findings pave the way for a range of transformative applications. By adjusting the initial phase of OAM light, they believe that revolutionary advancements in fields such as secure optical communication systems and advanced biomedical imaging will be possible in the future. ChristianaCare and Partners Launch Delaware’s First Nurse Anesthesiology Program
Wilmington University, in collaboration with ChristianaCare and the support of Anesthesia Services, P.A. (ASPA), announces the Delaware Nurse Anesthesiology Program at ChristianaCare and Wilmington University, Delaware’s first nurse anesthesiology program. This innovative, full-time, 36-month offering leads to a Doctor of Nursing Practice (DNP) degree, preparing graduates to sit for the National Certification Exam and become certified registered nurse anesthetists (CRNAs). A CRNA (or nurse anesthetist) is an advanced practice registered nurse who administers anesthesia and provides related care before, during, and after surgical, therapeutic, diagnostic, and obstetrical procedures. The program will offer students over 2,000 hours of hands-on clinical experience in high-acuity environments across various surgical specialties, supported by partnerships with ChristianaCare, ASPA—the largest anesthesia group in Delaware—as well as other health care organizations. With the college admissions application season in full swing, Robert Alexander, University Dean of Enrollment Management at Rochester, offers some perspective for all high school seniors as they begin to navigate the process and ultimately make a decision that is a match made, not a prize to be won. "When considering academic fit, don’t spend a ton time, energy and money trying to reverse engineer a way to game the system to find your way in. You don’t want to end up somewhere and find that you’re struggling just to keep your head above water, or that you’re swimming with sharks in a cutthroat and competitive environment. Once you identify a few characteristics that are important to your fit, then you can broaden your aperture to a range of schools that meet some of those parameters—the right size, campus type, focus, selectivity, and academic programs offered. "When it’s time to start filling out college applications, discern how you’ll tell YOUR story: in your essay or short answer responses; in how you determine which teachers you’ll ask to write recommendation letters; and in topics you raise in an interview. Remember, colleges aren’t looking for a single perfect archetype student, but rather a diverse array of students who are interesting in different ways. In fact, more important than someone who might be the “perfect applicant” is someone who acknowledges they’re not flawless, but wants to strive to become better. Find ways to convey what’s authentically you, emphasizing your strengths, but including some areas where you want to grow and change, and maybe some vulnerabilities, too. Multi-sector partnership leads to first practical pilot of vehicle-to-grid power
A multi-pronged effort led by corporations, industry associations and an academic research institution has launched the first practical pilot project of “vehicle-to-grid” power (V2G) set up so that industrial participants can scale it at low cost. Invented by the University of Delaware, V2G uses batteries in parked EVs to support the electric grid or to provide backup during power failures. This pilot is the first targeted toward large scale expansion, because it follows standards (by SAE and UL), uses production EVs (with UD modifications), complies with utility requirements, and qualifies for wholesale power markets. The pilot has been implemented by Delmarva Power (an Exelon Company), working with UD. The project has set up an electric utility fleet of EVs to begin providing power to balance the electric grid, using Ford Mach-E EVs in the Delmarva Power fleet, and following new rules of the Federal Energy Regulatory Commission (FERC) for distributed energy resources. These Delmarva Power fleet vehicles are driving for utility operations during normal work schedule and provide wholesale grid services for PJM Interconnection when parked. The cooperative effort was organized by Prof. Willett Kempton, originator of the V2G concept. Kempton said the resulting demonstration is significant because it shows a cost-effective pathway for standards based, regulatory-compliant, mass-manufactured V2G. “Our close collaboration with Ford Motor, based on our joint Memorandum of Understanding, was very productive. Ford engineers’ advice helped us fully integrate the car’s CAN communications with LIN-CP,” Kempton said. “Ford already markets a production EV with home backup power, and they have a sophisticated understanding of potential EV synergies with the electric power grid. We hope that collaborations like this will also help OEMs like Ford to see a path to incorporation of these new standards and technologies into production EVs.” The new standard for V2G signal definitions were finalized and approved just this year thanks to UD Research Professor Rodney McGee, Task Force Chair of the SAE standards development for J3400 (NACS) and J3068. (SAE was formerly called Society of Automotive Engineers.) “These standards define the signaling to standardize low-cost AC charging, with all the functionality needed for safe operation of V2G and backup power from an EV. Both these standards implement a signaling method that is new to EV charging, called LIN-CP, yet is built from easy-to-implement automotive technologies,” McGee said. UD’s MOU with Ford Motor Company allowed the two parties to cooperate on implementing sophisticated signaling for low-cost, high-functionality V2G. UD designed a retrofit package for proof of concept. The design was led by UD Postdoc Garrett Ejzak and used a bidirectional on-board charger and the new LIN-CP commands to make the Mach-E capable of sophisticated V2G. After testing at UD, the design was installed in four Delmarva Power fleet Mach-Es, to test these systems in a real-world fleet operating environment. In addition to proving these new SAE standards, this project also shows that EVs can be high-value grid services providers to the electric system under the new FERC Order 2222 regulations. This new Federal rule enables small resources to collectively participate in electric markets to make the electric grid more reliable and more capable of incorporating fluctuating renewable power sources. PJM Interconnection, which manages the electric grid over 13 states, is participating under a Pilot Project agreement with the Delmarva Power demonstration, as an early proof of PJM’s new rules to meet FERC Order 2222 compliance. “The use of virtual power plants, such as aggregations of electric vehicles, is an emerging resource type that can contribute to managing the energy transition by providing flexibility and other services needed to reliably operate the power grid,” said Scott Baker, Sr. Business Solution Analyst – Applied Innovation for PJM. “We look forward to working with Delmarva Power and the project team to test the technical capabilities of V2G electric vehicles and understand how this use case integrates with PJM’s new market construct for virtual power plants and DER Aggregators.” Delmarva Power’s parent company, Exelon Corporation, is also a partner providing support for the project. Project partner Nuvve Holding Corporation (Nuvve) updated their charging stations for full LIN-CP and V2G capabilities. Then project partner Delmarva Power installed four Nuvve charging stations at their facility in Newark, Delaware. The four individual Mach-Es are virtually combined into one V2G “power plant” by aggregation software from Nuvve Holdings. Nuvve CEO Gregory Poilasne described this: “Our Nuvve charging stations now talk LIN-CP and implement the new SAE standards. This enables our GIVe aggregator software to tap high functionality V2G EVs,” Poilasne said. “By combining EVs as a single power resource, our technology is already serving as a “Distributed Energy Resource Aggregator” as specified by FERC Order 2222.” The EVs’ performance and provision of grid services will be monitored over the next year by UD and Nuvve to provide documentation on their use both as fleet vehicles and as grid resources.

Post-Pandemic: How Alcohol Is Harming the Health of More Women
The prevalence of alcohol-related complications has been steadily increasing over the years, but a significant surge occurred during the pandemic, particularly among women aged 40 to 64. According to a JAMA Health Forum report titled High-Acuity Alcohol-Related Complications During the COVID-19 Epidemic, there was a significant increase in severe alcohol-related complications in women and alcoholism. The majority of these, 54% to 66%, were alcohol-related liver disease; smaller numbers, 3% to 5% and 1% to 3% were attributed to alcohol-related cardiomyopathy and alcohol-related gastritis with bleeding, respectively. What the trends mean If these trends persist, the increases in alcohol-related complications will continue to harm women. There are several reasons explaining this increase. In addition to the overall increase in alcohol consumption, the pandemic exacerbated feelings of loneliness and uncertainty about the future. Additionally, lockdowns led to more time spent at home – an environment where alcohol is readily available. How alcohol affects women Women are particularly vulnerable to the adverse effects of alcohol due to differences in body structure and chemistry. They absorb more alcohol and take longer to metabolize it. This means smaller amounts of alcohol can cause more serious health issues. Also, the shift towards drinking at home, which was further made easier by convenient online shopping and home delivery during the pandemic, led to increased consumption without judgment. Addressing any substance misuse needs a multimodal approach. There are treatment options and medications that can help. It is important to wean yourself off alcohol with a doctor’s supervision, as withdrawal can be severe and dangerous. Getting help Health care providers, patients and their loved ones can all partner in enhancing education and awareness about alcohol use risks and reducing stigma in seeking treatment when needed. It’s important for women to recognize that they are not alone and that help is available. It is a difficult addiction for anyone to go through, but education and support can significantly improve outcomes.

EU-UK Trade Deal continues to stifle trade with 27% drop in exports since 2021
New report shows persistent stifling effects of the impact of the Trade and Cooperation Agreement on UK-EU trade relations Monthly data show a 27% drop in UK exports and a 32% reduction in imports to and from the EU between 2021 and 2023 Recommendations for policy interventions include to negotiate sector-specific deals, engage with individual EU countries, and work on reducing non-tariff barriers A comprehensive analysis by researchers at the Centre for Business Prosperity at Aston University reveals that negative impacts of the UK-EU Trade and Cooperation Agreement (TCA) have intensified over time. The new report, Unbound: UK Trade Post Brexit, also shows a 33% reduction in the variety of goods exported, with the agricultural, textiles, clothing and materials sectors most affected. To assess the impact of the UK-EU TCA, the authors analysed monthly import and export between the UK and the EU, from January 2017 to December 2023 and separated into pre- and post-January 2021 when the agreement came into force. The monthly data shows a 27% drop in UK exports and a 32% decline in imports from the EU. Lead author, Professor Jun Du of Aston University says: “The Trade and Cooperation Agreement introduced substantial barriers and there are ongoing and marked declines in the value and variety of UK exports and imports. Without urgent policy interventions, the UK’s economic position and place in the global market will continue to weaken.” The UK-EU TCA redefined trade and investment rules and market access between the UK and the EU. Since it came into force, the UK government has negotiated several trade agreements, but the EU remains the UK’s largest trade partner. Exports for most sectors have decreased since January 2021, although the impact is varied. Agrifood, textile and clothing and material-based manufacturing have been among the hardest hit, with substantial declines in both export value and the variety of products exported. At the same time, some sectors such as tobacco, railway and aircraft manufacturing have seen modest increases in varieties of products exported. On the import side, most sectors have shrunk in both value and variety, particularly agrifood products, optical, textile and material-based manufacturing. A few sectors, for example, ships and furniture, have demonstrated noticeable increases in import product variety. The large variations across different goods categories and EU trade partners underscore the uneven effects of Brexit and the TCA on UK-EU trade dynamics, highlighting the need to understand the nuances and come up with tailored strategies that address the unique challenges of each sector within the new regulatory environment. The researchers make recommendations, outlining how sector-specific negotiations, streamlining customs procedures with digital technologies and reducing regulatory divergence could mitigate some of the impacts. Dr Oleksandr Shepotylo, the report’s co-author says: “Our findings indicate a decoupling of the UK from key EU final goods markets, accompanied by a shift in UK supply chains toward geographically closer EU trading partners for exports and smaller countries for imports. “This shift raises concerns and underscores the urgent need for a strategic reconfiguration of UK supply chains to maintain competitiveness.” Professor Du continues: “The TCA has introduced considerable barriers to UK-EU trade, particularly through increased Non-tariff measures (NTMs). “Addressing these issues through targeted improvements to the TCA is crucial to ensuring that UK businesses remain competitive in the European market. VR Simulation to Demonstrate the Danger of Snow Squalls
Since 2017, Dr. Jase Bernhardt, Hofstra associate professor of geology, environment, and sustainability, has been using virtual reality technology to teach the public about the dangers of rip currents, hurricanes, and flash flooding. His most recent award, a $100,000 Road to Zero Community Traffic Safety Grant from the National Safety Council, is enabling him to tackle another seasonal weather worry: driving in snow squalls. The National Safety Council received funding for this grant from the National Highway Traffic Safety Administration. Bernhardt’s project aims to share information about the onset of snow squalls, the importance of heeding emergency weather advisories, and what drivers should do if they are on the road when a snow squall occurs. Although squalls are infrequent, they are extreme and frightening winter weather events that can result in a rapid onset of heavy snow, low visibility, icy roadways, and frigid temperatures. “Snow squalls are a very specific type of weather phenomenon. They often occur on a clear, calm day, with no warning of precipitation,” Bernhardt said. “Seemingly out of nowhere, you’ll see clouds, followed by a quick burst of very heavy snow. For a short time, perhaps only 10, 15 minutes, there are whiteout conditions where drivers can barely see the road ahead of them.” According to the U.S. Department of Transportation website, 24% of weather-related vehicle crashes occur on snowy, slushy, or icy pavement, and 15% happen during snowfall or sleet. More than 1,300 people are killed and nearly 117,000 people are injured in vehicle crashes on snowy, slushy, or icy pavement annually. Because winters in the New York metropolitan area have been mild for the last few years, Bernhardt worries that people have been lulled into a false sense of security about driving during winter storms or squalls. “We’re not used to being in that kind of severe weather anymore,” he said. “Snow squalls can be deadly in terms of massive collisions and multi-vehicle chain collisions. The key thing to remember is that they come in rapidly, catching people by surprise.” Bernhardt is collaborating on the software for the snow squall VR simulation with Frank Martin ’22, ’23, who earned both a BS and an MS in Computer Science from Hofstra University. Users will wear a headset and hold a device – like a video game controller – in each hand to replicate the movements of a steering wheel. Bernhardt said that if a warning for a snow squall is issued via emergency broadcast, he hopes people who have used the simulation will understand the urgency of getting off the road or pulling onto the shoulder and remaining in their vehicle. “We want people to have an experience that is as close to reality as possible. The idea is to simulate how sudden and terrifying snow squalls can be and give people an opportunity to learn what they should and should not do if they are caught in one,” Bernhardt said. In conjunction with the VR simulation, Bernhardt is developing a survey to determine people’s reactions to emergency messaging and how effective it is. He will work with the National Weather Service to have the simulation and surveys available by fall 2025 for use at training and outreach events throughout the Northeast. Like Bernhardt’s rip current project, there are plans to have a version of the snow squall simulation and corresponding literature available in Spanish. Putting a price tag on environmental projects
Unlike a grocery store, the goods and services in the environment — think clean water, tree cover, or flood control — don’t come with a price tag. Researchers in the University of Delaware Department of Applied Economics and Statistics have received a $1.5 million grant to assess the value of what is gained or lost from environmental projects. The three-year grant from the U.S. Army Engineer Research and Development Center, the chief research and development center for the federal environmental engineering agency U.S. Army Corps of Engineers, will pave the way for UD environmental economists to develop a web-based platform to help the Corps. The research team is led by Maik Kecinski, associate professor in the Department of Applied Economics and Statistics and also includes department colleagues Kent Messer and Martin Heintzelman, as well as three graduate researchers. The team will create an online platform to help the Corps estimate the monetary value of the ecosystem impacts through its ongoing and proposed projects across the U.S. Kecinski said many of the Corps’ projects involve natural resources, such as building dams or restoring rivers. Those projects require labor hours and equipment, each with a market value. “But the big piece the Corps doesn’t have is what is the environmental value that’s created or lost through these projects?” Kecinski said. The project came about after ERDC representatives visited UD in 2023. Kent Messer, Professor of Applied Economics, presented research about behavioral aspects around water quality and conservation and learned about ERDC’s research needs. Messer said that the big takeaway from those discussions was that ERDC was interested in having a platform to show the ecosystem services value of its projects. “So that was an exciting opportunity to connect and partner with them on the development of a tool that could help them in this regard,” Messer said. Messer said the opportunity to work with the Corps to assess its projects nationwide is “huge” for the University and for UD’s College of Agriculture and Natural Resources. “It speaks enormously to our college’s prominence in environmental economics issues,” Messer said. Martin Heintzelman, chair of UD's Department of Applied Economics and Statistics, said the project will help raise the profile of the department. “This is really in our wheelhouse in terms of the kind of research we do,” Heintzelman said. “It’s a great opportunity for us to be applying research to policymakers, people who are going to use this work to make better decisions as they’re going about their work constructing, managing, and sometimes de-constructing water and related projects.” The researchers hope the web-based platform will play a role in policy and decision-making, helping the Corps make more informed decisions on environmental projects in the future. “One thing I hope is going to come from this is the choices we make today are going to create a better tomorrow. That’s what it is all about” Kecinski said.
